FARNHAM COMMON TENNIS CLUB RULES
Approved at FCTC AGM November 2020
1 NAME
The Club shall be called “Farnham Common Tennis Club”.
2 OBJECTIVES
2.1 To provide tennis, social and other activities and generally to encourage and facilitate the playing of tennis.
2.2 To promote, improve, develop and support the interests of tennis.
2.3 To offer coaching and competitive opportunities in Ladies, Men’s, Mixed and Junior tennis.
2.4 To ensure a duty of care to all members of the Club.
2.5 To provide all its services in a way that is fair to all.
2.6 To support the aims and objectives of Farnham Common Sports Club.
2.7 To be a registered Associate of the LTA through the County Lawn Tennis Association (CLTA) and to comply with and uphold the Rules and Regulations of the CLTA and the LTA as amended from time to time and the rules and regulations of any body to which the LTA is affiliated.
2.8 To endeavour to ensure that all players using the facility will uphold the LTA Disciplinary Code.
2.9 To do all such other things as the Management Committee thinks fit to further the interests of the Club or to be incidental or conducive to the attainment of all or any of the objects stated above.
3 MEMBERSHIP
3.1 Membership fees will be reviewed annually and are set by Farnham Common Sports Club Main Committee
.
3.2 Membership of the Club will be on an annual basis, running from 1st January to 31st December each year.
3.3 All members will be subject to the rules and regulations of the Tennis Club and Farnham Common Sports Club and by joining the Club will be deemed to accept the rules, regulations and codes of conduct that the Club has adopted.
3.4 Membership is offered in a number of categories, which are agreed by Farnham Common Sports Club Main Committee. Current categories are listed on FC Sports Club main website.
3.5 Each member (of each category) agrees as a condition of membership:
(A) to be bound by and subject to the rules of The Club
(B) to be bound by and subject to the LTA Rules and the LTA Disciplinary Code.
3.6 Rule 3.5 confers a benefit on the LTA and, subject to the remaining provisions of this rule, is intended to be enforceable by the LTA by virtue of the Contracts (Rights of Third Parties) Act 1999. For the avoidance of doubt, the members do not intend that any term of these rules should be enforceable, by virtue of the Contracts (Rights of Third Parties) Act 1999, by any person who is not a party to this agreement.
3.7 The Management Committee may terminate the membership of any person, or impose any other sanction they determine to be appropriate, in connection with the breach of any condition of membership set out in this rule.
4 TENNIS CLUB MANAGEMENT COMMITTEE
4.1 The Club shall be managed by a Management Committee, which will consist of an elected body of Officers and Committee members. The Management Committee shall have the power to fill any casual vacancy for Club Officers and to co-opt up to two further Committee Members as they decide necessary.
4.2 The responsibility of the Management Committee shall include, but not be limited to the following:
4.2.1 Advising the Main Committee on the running of the Tennis Club.
4.2.2 Advising the Main Committee on the upkeep and maintenance of the tennis facilities.
4.2.3 Arranging matches and tournaments
4.2.4 Adopting new policies for playing and other matters
4.2.5 Reviewing and enforcing codes of conduct
4.2.6 Reviewing and enforcing rules affecting the organisation of the Club
4.2.7 Appoint Sub Committees / Advisers to help fulfil its business
4.2.8 Monitoring and reviewing the coaching and tennis programme offered by the Club
4.3 The Management Committee shall be convened by the Chairman of the Tennis Club/Section Secretary and meetings held no less than eight times per calendar year.
4.4 The quorum required for business to be agreed at Management Committee Meetings will be 50% of the total number of Officers plus one.
4.5 All Officers and Committee Members will have the right to vote at meetings of the Management Committee.
4.6 The Club agrees that each member of the Management Committee will be required, as a condition of election or appointment, to agree to be bound by and subject to these rules, the LTA Rules and the LTA Disciplinary Code, such agreement to contain an express acknowledgement that the Contracts (Rights of Third Parties) Act 1999 applies and that the LTA and The Club can enforce any breach at its option and in its sole discretion.
5 OFFICERS
5.1 The Officers of the Club shall be:
5.1.1 Tennis Club Chairman/Section Secretary
5.1.2 Communication Officer
5.1.3 Membership Secretary
5.1.4 Welfare and Safeguarding Officer
5.1.5 Fixture Secretary
5.1.6 Ladies’ Captain
5.1.7 Men’s Captain
5.1.8 Maintenance Officer
5.1.9 Parent Representative
5.1.10 Events organiser
5.2 All officers will retire each year but will be eligible for re-election.
5.3 Officers will be elected annually at the Annual General Meeting.
5.4 The Management Committee shall decide in its discretion how Club Members may be nominated to be members of the Management Committee and shall notify the Members accordingly.
6 FINANCE
6.1 All finances relating to the Club will ultimately be the responsibility of the Farnham Common Sports Club Treasurer.
7 DISCIPLINE
7.1 A separate Committee will be responsible for disciplinary hearings of members who infringe the Club rules or regulations. This will be convened if a need arises.
7.2 The Disciplinary Committee will be responsible for taking any action following such hearings.
7.3 A separate policy document will be published describing full responsibilities of the Officers of the Club.
8 ANNUAL GENERAL MEETING
8.1 The Annual General Meeting (AGM) will be chaired by an Officer of Farnham Common Sports Club Main Committee.
8.2 The AGM of the Club shall be held after all summer Shield matches have been completed but no later than 30th November.
8.3 Notice of the AGM will be given at least 10 days before the meeting. All members will be deemed to have received proper notice if the notice was sent 10 days prior to the meeting to their last notified e-mail address and the notice was also displayed on the notice board in the Main Clubhouse, Club pavilion and on the Club website 10 days prior to the meeting.
8.4 Any documents to be presented at the AGM will be distributed no less than 7 days prior to the meeting.
8.5 The AGM will receive reports from the Club Officers.
8.6 The Officers of the Club shall be appointed at the AGM.
8.6.1 All nominations must be proposed and seconded and the nomination forwarded to the Chairman to be received at least 5 days before the meeting.
8.6.2 Further nominations may be taken at the AGM provided the nominees agree to stand and are fully
proposed and seconded. If the nominee is unable to attend the AGM then they must signify their
willingness to stand before the meeting, preferably in writing.
8.6.3 Only female members may vote for the Ladies’ Captain and male members for Men’s Captain.
8.6.4 Where there is more than one nomination there shall be a ballot or show of hands as decided by the
chairman of the meeting.
8.6.5 In the event of a tie the decision shall be made by drawing lots.
8.7 Any other business is to be taken at the discretion of the Chairman of the meeting.
8.8 The quorum for this meeting shall be 15.
8.9 All members have the right to attend the AGM but only members over the age of 18 have the right to vote.
9 EXTRAORDINARY GENERAL MEETING
9.1 An Extraordinary General Meeting (EGM) of the Club may be called at the discretion of the Management Committee or upon the receipt of a written request signed by at least 25 members. The request must specify the purpose of the EGM and set down a motion for debate.
9.2 Following receipt of such a request the Tennis Club Chairman will convene the EGM by giving at least 10 days written notice of the meeting and the proposed motion. All members will be deemed to have received proper notice if the written notice was sent 10 days prior to the meeting to their last notified e-mail address and the notice was also displayed on the notice boards in the Main Clubhouse, Club pavilion and on the Club website 10 days prior to the meeting.
9.3 Any documents to be presented at the EGM will be distributed no less than 7 days prior to the meeting.
9.4 The EGM must be convened within 21 days of receipt of the written request.
9.5 The EGM will be chaired by an Officer of Farnham Common Sports Club Main Committee.
9.6 The quorum for this meeting will be 15.
9.7 Voting on the motion will be via a ballot with a simple majority deciding the outcome. In the event of a tie the Chairman of the Tennis Club shall be entitled to a second or casting vote.
10 ALTERATIONS AND ADDITIONS TO THE RULES
10.1 No alteration(s) to the rules may be made, except at an Annual General Meeting or an Extraordinary General Meeting and such amendments must appear on the Notice and Agenda of such meetings as issued by the Club Chairman.
10.2 The alteration(s) can be approved by majority vote.
11 CHILD PROTECTION POLICY
The Club will issue a Child Protection Policy. The Policy will be displayed on Club notice board(s) and on the Club website. Policy for this will be formulated in accordance with LTA/Sport England/Farnham
Common Sports Club Guidelines.
12 EQUALITY POLICY
The Club will issue an Equality Policy. The Policy will be displayed on Club notice board(s) and on the Club website. Policy for this will be formulated in accordance with LTA/Sport England/Farnham
Common Sports Club guidelines.
13 DEFINITIONS
“The Club” means Farnham Common Tennis Club
“CLTA” means Buckinghamshire County Lawn Tennis Association
“LTA” means by Lawn Tennis Association Ltd and its subsidiaries or such successor or entity or entities as become(s) the governing body of the game of lawn tennis from time to time
“LTA Rules” means the rules of the Lawn Tennis Association as in force from time to time
“Disciplinary Code” means the disciplinary code of the LTA in force from time to time
“Chairman” means the person elected from time to time to be the Chairman of The Tennis Club also known as the Section Secretary
“Main Committee” means the management committee of Farnham Common Sports Club
“Member” means the member of The Club.
